“APS,” “we,” “us,” and “our” refer to Applied Protection Service LLC. “You” and “your” refer to every person who accesses or uses the website.
By accessing or using the website, you acknowledge that you have read and agree to these Terms and the APS Privacy Policy. If you do not agree, discontinue use of the website.
1. Purpose of the Website
The website provides general public information about APS, including its organization, values, potential capabilities, service categories, employment opportunities, and methods of contact.
Website content is provided for general informational purposes only.
Nothing on the website constitutes:
A binding offer to provide services;
A security assessment or operational plan;
A promise of staffing, coverage, or response;
A guarantee of safety, protection, or crime prevention;
Legal, medical, law-enforcement, or emergency-management advice;
A professional risk-management opinion;
A representation that a particular service is available in every location; or
A modification of any written contract or agreement.
All APS services remain subject to applicable licensing and legal requirements, geographic limitations, personnel and equipment availability, insurance requirements, operational assessments, client acceptance, and a separate written agreement.
2. No Client or Professional Relationship
Visiting the website, reviewing its content, submitting a contact form, sending an email, placing a telephone call, or requesting information does not create a client, agency, fiduciary, employment, medical, law-enforcement, attorney-client, or other professional relationship with APS.
A client relationship exists only after APS and the applicable client execute a written service agreement signed by authorized representatives.
APS is not obligated to accept an assignment, respond to an inquiry, provide a proposal, provide services, or enter into an agreement.
3. Private Security Organization
APS is a private organization and is not a government agency, police department, fire department, emergency medical service, emergency dispatch center, or other public-safety agency unless expressly stated in connection with a specific written agreement.
Nothing on the website represents that APS personnel possess governmental law-enforcement authority.
Descriptions of armed personnel, emergency-assistance capabilities, medical training, investigations, access control, or coordination with public-safety agencies do not authorize visitors to rely on APS as a substitute for police, fire, emergency medical, or emergency-management services.
4. No Emergency Communications
THE WEBSITE AND CONTACT FORM ARE NOT EMERGENCY COMMUNICATIONS SYSTEMS AND ARE NOT CONTINUOUSLY MONITORED.
Do not use the website, contact form, ordinary email, social-media account, or general business telephone number to:
Report a crime in progress;
Report an active threat;
Request immediate armed assistance;
Request emergency medical care;
Report a fire;
Report an immediate threat to life or property;
Report a missing or endangered person; or
Request urgent public-safety assistance.
For an emergency or immediate threat to life or property, call 911 or the appropriate local emergency service.
Sending APS an electronic communication does not guarantee that the communication will be immediately transmitted, received, reviewed, or answered.
5. No Guarantee of Protection
Security services may reduce certain risks but cannot eliminate every threat, hazard, crime, injury, loss, disruption, or emergency.
Nothing on the website guarantees that:
A crime, injury, loss, emergency, or security incident will not occur;
APS personnel will identify or prevent every hazard;
APS personnel will be available at a particular time or location;
Any particular number or type of personnel will be assigned;
Any particular vehicle, weapon, medical device, surveillance system, or other equipment will be provided;
Law enforcement, fire services, or emergency medical services will respond within a particular period;
A security plan will achieve a particular outcome; or
Any person or property will remain free from harm.
Actual duties, staffing, equipment, procedures, responsibilities, and performance standards are established only through applicable law, APS policy, operational requirements, and a written client agreement.
6. Contact Form and Electronic Communications
The website may provide a contact form for general business inquiries.
When you submit the contact form, APS may receive information that you voluntarily provide, including your name, email address, telephone number, organization, service interests, and message.
APS may use that information to review and respond to your inquiry, determine whether APS can accommodate a request, prepare a proposal, maintain appropriate business records, prevent fraud or abuse, protect legal and safety interests, and comply with applicable law.
Submitting the contact form:
Does not create a client or professional relationship;
Does not guarantee that APS will respond;
Does not guarantee that APS will provide services;
Does not constitute acceptance of an assignment;
Does not create a duty to act;
Does not authorize emergency dispatch or response; and
Does not enroll you in marketing communications unless you separately request or consent to them.
APS does not guarantee the confidentiality or security of information transmitted through ordinary web forms or email.
Do not submit the following through the contact form:
Social Security numbers;
Driver’s-license or passport numbers;
Payment-card or banking information;
Medical records or protected health information;
Passwords or authentication credentials;
Alarm codes, door codes, or encryption keys;
Detailed security vulnerabilities;
Confidential operational plans;
Classified or legally protected information; or
Information concerning an emergency or immediate threat.
By submitting the form, you represent that the information is accurate, that you have the authority to provide it, and that its submission does not violate another person’s privacy, confidentiality, contractual, or legal rights.
7. Privacy
Use of the website is also governed by the APS Privacy Policy, which is incorporated into these Terms by reference.
The Privacy Policy explains how APS and its service providers may process technical website information and information voluntarily submitted through the contact form.
APS does not sell website contact-form information or use it for cross-site behavioral advertising.
8. Employee Login and Google Workspace
The website may provide an “Employee Login” link that redirects authorized APS personnel to Google Workspace or another Google-operated authentication page.
The public Website does not authenticate employees and does not directly collect or store Google Workspace usernames or passwords.
Selecting the Employee Login link causes the user to leave the public APS Website. Access to Google Workspace is controlled through Google’s authentication systems and APS account-administration practices.
The Employee Login link is intended only for individuals authorized by APS. Unauthorized access or attempted access to any APS-managed account, system, file, communication, or resource is prohibited.
Authorized personnel remain subject to:
APS employment policies;
Acceptable-use requirements;
Information-security policies;
Confidentiality obligations;
Records-retention requirements;
Account-management policies;
Applicable employment agreements; and
Google’s applicable terms and policies.
APS may administer company-managed accounts and associated business records as permitted by applicable law and APS policy.
Access to Google Workspace is not guaranteed merely because a person can view or select the Employee Login link.
9. Accuracy of Website Information
APS makes reasonable efforts to provide accurate information. However, website content may contain errors, omissions, outdated statements, incomplete descriptions, or typographical mistakes.
APS does not warrant that website information is complete, current, accurate, or appropriate for a particular purpose.
Services, personnel, qualifications, service areas, equipment, rates, policies, organizational structures, operating plans, availability, and capabilities may change without notice.
Visitors should not rely on the website as the sole basis for any security, employment, purchasing, contracting, emergency, legal, or operational decision.
Information contained in a signed written agreement takes precedence over conflicting general information appearing on the website.

Actual assignments are determined by applicable law, licensing, policy, qualifications, availability, operational requirements, and written agreements.
11. Permitted Use
You may access and use the website only for lawful personal, informational, employment-related, or legitimate business purposes.
You may view and print a reasonable portion of public website content for personal reference or legitimate evaluation of APS services, provided you do not modify the content or remove copyright, trademark, or ownership notices.
APS permits ordinary crawling and indexing by legitimate search engines in accordance with APS’s published technical instructions.
No other automated, commercial, investigative, competitive, or data-extraction use is authorized without prior written permission from APS.
12. Prohibited Conduct

Conduct unauthorized reconnaissance against APS, its clients, facilities, personnel, contractors, vendors, or operations;

Impersonate APS, an APS employee, or an APS client;
Misrepresent an affiliation, endorsement, credential, rank, employment status, or authorization;

Interfere with APS personnel, clients, contracts, operations, or business relationships; or
Encourage, direct, or assist another person in prohibited conduct.
APS may restrict or block access, preserve evidence, notify affected parties, contact service providers, and refer suspected unlawful activity to appropriate authorities.
13. Security-Sensitive Information
Public website content is intended only to provide a general description of APS.
No public statement regarding staffing, equipment, vehicles, training, communications, response procedures, organizational structure, protected locations, or operational methods should be interpreted as a complete, permanent, or current operational disclosure.

Do not submit unsolicited confidential business plans, proprietary security information, trade secrets, or other information for which APS has not agreed in writing to accept a duty of confidentiality.
Submission of unsolicited information does not create a confidential, fiduciary, or professional relationship.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless APS and its members, officers, employees, agents, contractors, representatives, insurers, successors, and affiliates from claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable attorneys’ fees arising from or relating to:
Your unlawful use of the website;
Your violation of these Terms;
Your infringement of another person’s rights;
Your unauthorized use of APS intellectual property;
Your interference with website, account, or network security;
Information or material you submit in violation of law; or
Fraudulent, threatening, abusive, or unauthorized conduct associated with your use of the website.
This section does not require indemnification to the extent prohibited by applicable law.
22. Enforcement

23. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.
Any legal proceeding arising exclusively from the public website or these Terms must be brought in a court of competent jurisdiction located in Hardin County, Kentucky, unless applicable law requires a different jurisdiction or venue.
This provision does not alter the governing-law or dispute-resolution provisions of any separately executed written agreement.
24. Severability

The remaining provisions will remain in full force and effect.
25. No Waiver
APS’s failure to enforce a provision of these Terms does not waive APS’s right to enforce that provision or any other provision later.
A waiver is effective only when expressly made in writing by an authorized APS representative.
26. Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written permission from APS.
APS may assign these Terms in connection with a merger, reorganization, sale of assets, transfer of website operations, or other lawful business transaction.
27. Entire Agreement
These Terms and the APS Privacy Policy constitute the entire agreement between you and APS concerning use of the public website.
They do not replace or modify any separately executed client agreement, employment agreement, nondisclosure agreement, vendor agreement, or other written contract.
If a separately executed agreement conflicts with these Terms regarding its specific subject matter, the separately executed agreement controls.
28. Changes to These Terms
APS may revise these Terms when the website, APS operations, applicable laws, or service-provider relationships change.
Revised Terms will be posted on this page with an updated effective date.
Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
